Terms of Service

1. Parties and Acceptance
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Safariblocks Ltd, a company incorporated in Kenya, operating the Draimo AI platform and all associated services available at draimo.com and its subdomains ("Service").
By accessing or using the Service, including by using the chat interface, by uploading any file, or by completing a payment, you confirm that you have read, understood, and agree to be bound by these Terms and ourPrivacy Policy, which is incorporated herein by reference. If you do not agree, you must immediately cease all use of the Service.
If you are using the Service on behalf of an institution or organisation, you represent that you have the authority to bind that organisation to these Terms.
2. Nature of the Service
Draimo AI provides AI-powered services designed to support academic learning and campus information access. The Service includes conversational AI assistants, document analysis tools, campus information systems, and related educational utilities.
You expressly acknowledge and agree that:
- The Service is a study and information aid only. It does not constitute academic advising, professional tutoring, or any form of guaranteed examination preparation.
- AI-generated content, including topic summaries, practice questions, revision plans, and campus information responses, is probabilistic and may be inaccurate, incomplete, or outdated. Such outputs are not endorsed by any university, lecturer, or examination board.
- We do not guarantee any particular academic outcome, grade, or examination result from use of the Service.
- You are responsible for verifying all AI-generated information with official academic sources, your lecturer, or your institution before relying on it.
- The Service is not affiliated with, endorsed by, or officially connected to any educational institution unless expressly stated in a separate written agreement.
3. User-Uploaded Content and Copyright
The Service allows you to upload documents, including lecture slides, past examination papers, notes, and other academic materials ("Uploaded Content") for AI analysis. This section governs your rights and obligations with respect to Uploaded Content.
3.1 Your Representations and Warranties
By uploading any content to the Service, you represent and warrant that:
- You are the owner of the Uploaded Content, or you have obtained all necessary rights, licences, consents, and permissions required to upload, share, and allow the Service to process such content.
- The upload and processing of your content does not and will not infringe, misappropriate, or violate any third party's intellectual property rights, including copyright, under the Copyright Act, Cap. 130 (Laws of Kenya), the Berne Convention, or any other applicable law.
- You understand that lecture slides, course materials, and examination papers produced by lecturers and universities may be protected by copyright, and that uploading such materials without authorisation from the copyright holder may constitute infringement.
- You accept full and sole legal responsibility for ensuring that your Uploaded Content complies with all applicable intellectual property laws before uploading it.
3.2 Licence to Process Uploaded Content
By uploading content, you grant Safariblocks Ltd a limited, non-exclusive, non-transferable, royalty-free licence to store, process, and analyse your Uploaded Content solely for the purpose of providing the Service to you. We do not claim ownership of your Uploaded Content. This licence terminates when you delete your content or close your account, subject to our data retention obligations.
We do not use Uploaded Content to train general-purpose AI models or sell your materials to third parties. Uploaded Content is processed transiently by third-party technology providers solely to generate your analysis results. These providers are bound by data processing agreements that prohibit using your content for their own model training purposes. See our Privacy Policy for details.
3.3 Platform Liability Shield
Safariblocks Ltd is a platform provider and does not pre-screen, verify, or monitor Uploaded Content before processing. We act as a passive conduit for user-initiated document analysis. Accordingly:
- Safariblocks Ltd shall not be liable for any copyright infringement or other intellectual property violation arising from content uploaded by users.
- Liability for any such infringement rests solely with the user who uploaded the infringing content.
- We reserve the right to remove any Uploaded Content that we reasonably believe infringes third-party rights, without notice and without liability to you.
3.4 Copyright Infringement Notices
If you believe that any content on the Service infringes your copyright, please send a written notice tohello@safariblocks.comwith the subject line "Copyright Infringement Notice" including: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and its location; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorised; and (e) a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorised to act on their behalf. We will investigate and respond promptly.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation, including the Computer Misuse and Cybercrimes Act, 2018 (Kenya).
- Upload, distribute, or transmit content that infringes intellectual property rights, is defamatory, obscene, or otherwise unlawful.
- Attempt to gain unauthorised access to any part of the Service, other accounts, or related systems.
- Scrape, crawl, data-mine, or reverse-engineer any part of the Service.
- Reproduce, resell, or redistribute AI-generated outputs as your own work, or pass them off as originating from official university or examination board sources.
- Submit content designed to manipulate, confuse, or deceive the AI systems.
- Use the Service for any commercial purpose without our prior written consent.
- Interfere with or disrupt the integrity or performance of the Service.
- Impersonate Safariblocks Ltd, its staff, or any other person or entity.
We reserve the right to suspend or permanently terminate your account, without refund, if you breach this section or any other provision of these Terms.
5. Payments, Credits, and Refunds
Access to certain features requires the purchase of credits or subscription plans. All payments are processed by a licensed third-party payment provider and are subject to their terms. By making a payment you confirm you are authorised to use the payment method provided.
- Credits are non-refundable once consumed by the Service (i.e., once an AI response has been generated). Credits for failed requests are automatically refunded to your account balance.
- Subscription plans grant access to features for the duration of the plan. Unused credits at plan expiry are forfeited unless otherwise stated.
- All prices are in Kenyan Shillings (KES) and are inclusive of any applicable taxes unless stated otherwise.
- We reserve the right to modify pricing with at least 7 days' notice published on the platform.

6. Intellectual Property
The Service, including all software, algorithms, user interfaces, branding, text, graphics, and AI integrations, are the exclusive property of Safariblocks Ltd and its licensors, protected by the Copyright Act, Cap. 130, trade mark law, and other applicable Kenyan and international laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond a limited, revocable licence to use it in accordance with these Terms.
You retain ownership of content you create independently (for example, your own notes typed into the chat). AI-generated responses produced for you are licensed to you for personal, non-commercial study use only.
7. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY KENYAN LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.
We do not warrant that: (a) the Service will be error-free or uninterrupted; (b) AI-generated content will be accurate, complete, or current; (c) AI-generated study outputs will reflect actual examination content; or (d) the Service will meet your specific academic requirements or lead to any particular result.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SAFARIBLOCKS LTD, ITS DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, ACADEMIC FAILURE OR LOSS OF OPPORTUNITY, REPUTATIONAL HARM, OR ANY CLAIM ARISING FROM UPLOADED CONTENT.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM; OR (B) KES 1,000.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
9. Indemnification
You agree to indemnify, defend, and hold harmless Safariblocks Ltd and its directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your Uploaded Content, including any claim that it infringes a third party's intellectual property rights; (c) your breach of these Terms; or (d) your violation of any applicable law or regulation.
10. Data Protection and Privacy
Your privacy is important to us. Our processing of your personal data is governed by ourPrivacy Policy, which complies with Kenya's Data Protection Act, 2019. By using the Service, you consent to the collection and use of your data as described in that policy.
Uploaded documents are processed in accordance with our Privacy Policy and are not retained longer than necessary for the provision of the Service. We implement industry-standard security measures to protect your data against unauthorised access, loss, or disclosure.
11. Third-Party Services
The Service integrates third-party technology providers for infrastructure, AI processing, and payment handling. Your use of such components may be subject to those providers' own terms and policies. We are not responsible for the actions, content, or privacy practices of third-party providers.
12. Modifications to the Service and Terms
We reserve the right to modify, suspend, or discontinue any part of the Service at any time without liability to you. We also reserve the right to amend these Terms at any time. Where changes are material, we will provide at least 14 days' notice via email or a prominent notice on the platform. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
13. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, indemnification, and limitation of liability) shall survive.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Kenya, without regard to conflict of law principles. Any dispute arising from or related to these Terms or the Service shall be submitted first to good-faith mediation between the parties. If mediation fails within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
15. General Provisions
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Safariblocks Ltd regarding the Service and supersede all prior agreements.
- No Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right.
- Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
- Force Majeure: We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control.
